1. Acceptance of Terms
By accessing or using Nutrivate ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. These terms constitute a legally binding agreement between you and Nutrivate.
We may update these terms from time to time. Continued use of the Service after changes are posted constitutes your acceptance of the revised terms.
2. Description of Service
Nutrivate is an AI-powered variable rate nitrogen prescription platform designed for Saskatchewan grain farmers. The Service processes field shapefiles, yield data, and agronomic inputs to generate zone-specific nitrogen application recommendations using artificial intelligence.
The Service includes:
- Upload and processing of precision agriculture files (shapefiles, CSVs)
- AI-generated nitrogen prescriptions based on yield zone analysis
- Exportable variable rate application files compatible with farm equipment
- Field analysis history and dashboard
- Integration with John Deere Operations Center (where connected)
3. Free and Professional Tiers
Free Plan — The Free plan allows up to 3 field analyses at no cost. Free plan users have access to core prescription generation, field dashboards, and CSV export. No payment information is required.
Professional Plan — The Professional plan is available for $99/month CAD and includes:
- Unlimited field analyses
- Multi-year season comparisons and historical trend analysis
- Priority AI processing
- Advanced export formats
- Priority email support
Professional subscriptions are billed monthly and may be cancelled at any time. Cancellation takes effect at the end of the current billing period. No refunds are issued for partial months.
4. Accuracy Disclaimer
Important: All nitrogen rate recommendations generated by Nutrivate are produced by artificial intelligence and are provided for informational purposes only. These recommendations have not been verified by a licensed agronomist and should be reviewed by a qualified agronomist before application. Nutrivate is not liable for crop losses, yield reductions, environmental damage, or any losses arising from input decisions made based on AI-generated recommendations.
Agronomic outcomes depend on many factors outside Nutrivate's control, including weather, soil variability, pest pressure, equipment calibration, and operator decisions. The Service is a decision-support tool — not a substitute for professional agronomic advice.
Nutrivate makes no warranties, express or implied, regarding the accuracy, completeness, or fitness for purpose of any prescription generated by the Service.
5. Data Privacy
We take the privacy of your farm data seriously. Your field data, yield records, and analysis results are stored securely and are never sold, shared, or disclosed to third parties for commercial purposes.
Farm data is used solely to generate your prescriptions and improve the accuracy of the Service. For full details, please review our Privacy Policy.
6. Payment Terms
The Professional plan is billed at $99/month CAD. Payments are processed securely through our payment provider. By subscribing, you authorize recurring monthly charges to your payment method on file.
You may cancel your subscription at any time from your account settings. Access remains active until the end of the current billing cycle. Nutrivate reserves the right to modify pricing with 30 days' notice to existing subscribers.
7. Intellectual Property
The Nutrivate platform — including its software, algorithms, design, brand, and content — is the intellectual property of Nutrivate and its creator. You may not copy, reproduce, distribute, or create derivative works from any part of the Service without written permission.
You retain full ownership of all field data and agronomic files you upload. By uploading data, you grant Nutrivate a limited licence to process that data for the purpose of generating your prescriptions and improving the Service.
8. Limitation of Liability
To the maximum extent permitted by applicable law, Nutrivate and its creator shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to crop losses, loss of profits, data loss, or business interruption — arising from your use of the Service.
In no event shall Nutrivate's total liability to you exceed the total amount you paid for the Service in the three months preceding the claim.
9. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the Province of Saskatchewan, Canada, without regard to conflict of law provisions. Any disputes shall be subject to the exclusive jurisdiction of the courts of Saskatchewan.
